Questions

Is this legal advice?

No. These are general formats to save you typing. Laws, stamp duty and the wording officials accept differ by country and state, so check with a notary, oath commissioner or lawyer before you sign anything.

Why are many Indian rent agreements for 11 months?

Under the Registration Act, a lease of 12 months or more must be registered, which costs stamp duty and registration fees. An 11-month agreement avoids compulsory registration in many states, but states have their own rules (Maharashtra, for example, requires leave and licence agreements to be registered) and an unregistered agreement is weaker evidence in a dispute.

What is stamp duty on a rent agreement?

It depends on the state and is usually a small percentage of the rent and deposit for the period. Many states let you buy e-stamp paper online or at authorised centres. Print the agreement on stamp paper of the right value, or attach the e-stamp certificate.

What should I check before signing?

The exact property and fittings, rent and due date, deposit and how it is refunded, who pays bills and maintenance, the notice period, lock-in, and the rent increase. Both parties and two witnesses sign every page, and each party keeps a signed original.
